Objectives:
ELSA Spain and Fide are holding a meeting that will be conducted in English, by virtue of the institutional relations between ELSA Spain and Fide.
On 11 July 2025, the Second Section of the Contentious-Administrative Chamber of the High Court of Justice of Galicia handed down ruling no. 303/2025, partially upholding the claim for inaction against the hydrographic entity and the regional administration, after following a procedure through the special procedure for the protection of fundamental rights with legal basis in climate and environmental litigation, for the violation of the human rights of the residents of the town of As Conchas. The session will also address the most recent developments concerning the so called Limia Judgment. Following the confirmation of the ruling by the Supreme Court of Spain, the judicial finding that public authorities failed to adequately prevent and address nitrate pollution linked to intensive livestock activity has become final and enforceable. The discussion will examine both the legal reasoning underpinning the decision and the scientific evidence presented in court, including isotopic and conventional chemical analyses, that substantiated the livestock origin of the contamination. Particular attention will be given to the implications of this landmark case for environmental governance, administrative accountability, and the use of scientific data in judicial decision making.
During the session, the analytical and scientific grounds will be presented to demonstrate, through expert testimony, the livestock origin of nitrate pollution. The combined use of isotopic techniques and conventional chemical analysis will be explained. In addition, the arguments that led to the court’s decision will be discussed.
