Objectives:
Koen Lenaerts recently wrote that ‘the autonomy of the EU legal order is part of the very DNA of that legal order, allowing the EU to find its own constitutional space whilst interacting in a cooperative way with its Member States and the wider world’. Investment lawyers have adopted a less positive view of the Court’s approach to the autonomy of EU law. This presentation will explore the post-Achmea line of cases on the autonomy of EU law, in particular with regard to investment law, inquire into the consequences of that case law and ask the question whether the Court’s approach to the autonomy of the EU legal order is appropriate or requires a recalibration.
Methodology: The dynamic of the session will respect the usual rules of Fide and the participation and interaction of the speakers and attendees as well, making only the changes required for its celebration on line. All sessions organized at Fide are convened under the Chatham House Rule, participants have the right to use the information they receive, but neither the identity nor the affiliation of any other participant may be revealed.
