Objetivos:
The BSH ruling raises many questions, both in terms of its reasoning and the potential repercussions it may have on international patent litigation.
The following issues can be highlighted, without claiming to be exhaustive:
1. How does the BSH ruling change the Court of Justice of the European Union’s doctrine in GAT and SOLVAY?
2. How does one arrive at the solution established in BSH based on the same theoretical approaches as in GAT and SOLVAY?
3. How should the guidelines set out in paragraph 51 of the judgment be interpreted, and how might they be applied?
4. Can the BSH judgment be taken as an indication of future changes? For example, in terms of the harmonization/approximation of Member States’ regulations regarding the effects of incidental rulings on patent validity.
5. What impact does the BSH judgment have on international litigation practice, including the long-arm jurisdiction of national courts of Member States with regard to third countries, the long-arm jurisdiction of the UPC and parallel proceedings?
The session aims to encourage reflection on these points, as well as any others raised by the case in the opinion of those attending.
